INFORMATION COLLECTION AND USE
- Information Collection
DEALTEK is the sole owner of the DEALS Software published on the Site. DEALTEK collects information from our Subscribers at several different points on the Site.
- Registration
In order to use this Site, a Subscriber must first complete the on-line subscription form or countersign a subscription letter. During registration a Subscriber is required to give contact information (such as name and email address) for purposes of obtaining a Subscription License (infra).
- Subscription License
We request information from the Subscriber at the time of Registration on our subscription form. A Subscriber must provide contact information (such as name, email, and shipping address) in order to receive a Subscription License in accordance with DEALTEK's Terms and Conditions. This information is used for billing purposes. If we have trouble processing an order, the information is used to contact the Subscriber.
- Information Use
DEALTEK will not share Subscriber Accounts, Subscriber Data, or Subscriber Work Product with third parties. DEALTEK will not allow other Subscribers access to Subscriber Accounts, Subscriber Data, or Subscriber Work Product provided by or generated by you or any other Subscriber when using DEALS as indicated in Sharing of Information (infra).
DEALTEK reserves the right to send electronic mail to any and all Subscribers in accordance with Section III of the Terms and Conditions.
DEALTEK reserves the right to access your Subscribers Account in accordance with Section IV of the Terms and Conditions.
- Profile
DEALTEK stores information that is collected through the subscription form, log files, and cookies to create a profile of our Subscribers. A profile is stored information that we keep on individual Subscribers that details their viewing preferences. Consequently, collected information is tied to the Subscribers personally identifiable information to provide offers, including subscription renewal notices, and improve the content of the Site for the Subscriber. This profile is used to tailor a Subscriber's visit to our Web site, and to direct pertinent DEALTEK marketing promotions, including subscription renewal notices, to them. DEALTEK will not share your profile with third parties.
- Cookies
A cookie is a piece of data stored on the Subscriber's computer tied to information about the Subscriber. DEALTEK uses both session ID cookies and persistent cookies. For the session ID cookie, once Subscribers close the browser, the cookie simply terminates. A persistent cookie is a small text file stored on the Subscriber's hard drive for an extended period of time. Persistent cookies can be removed by following Internet browser help file directions.
By setting a cookie on our site, Subscribers would not have to log in a password more than once, thereby saving time while on our site. If Subscribers reject the cookie, they may still use our site. The only drawback to this is that the Subscriber will need to remember and reenter the password upon each access. Persistent cookies enable us to track and target the interests of our Subscribers to enhance and expedite the experience on our site. See the "Profile" section.
- Log Files
Like most standard Web site servers, DEALTEK's servers use log files. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track Subscriber's movement in the aggregate, and gather access and usage information for aggregate use. IP addresses are tied to personally identifiable information to enable our Web-based service.
COMMUNICATIONS FROM DEALTEK
- Special Offers and Updates
DEALTEK sends all new Subscribers a welcoming email to verify the subscription and assign the Subscriber name and password. Current Subscribers will occasionally receive information on products, services, and special deals.
- Service Announcements
On occasion, it may be necessary to send out a strictly service related announcement. For instance, if our service is temporarily suspended for maintenance, DEALTEK may send Subscribers an email. Generally, Subscribers may not opt-out of these communications, though they can deactivate their account. However, these communications are not promotional in nature.
- Customer Service
DEALTEK communicates with its Subscribers on a regular basis to provide requested customer support and technical support services. In regards to issues relating to their accounts, we reply via email or phone, in accordance with the Subscribers' wishes.
SHARING OF INFORMATION
- Legal Disclaimer
Though DEALTEK makes every effort to preserve Subscriber privacy, DEALTEK may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on our Web site.
- Subscriber Accounts, Subscriber Data, and Subscriber Work Product for Use with DEALS
DEALTEK recognizes that there are two types of information displayed on the Site: (i) information created and provided by DEALTEK in DEALS; and (ii) Subscriber Accounts, Subscriber Data, or Subscriber Work Product for use in connection with DEALS. Access to Subscriber Accounts, Subscriber Data, and Subscriber Work Product for use with DEALS will be limited to DEALTEK's employees and the Subscriber only. DEALTEK will take every precaution to ensure that Subscriber Accounts, Subscriber Data, and Subscriber Work Product are securely maintained on DEALTEK's computer servers in accordance with Security provision of this Privacy Agreement (infra).
Subscriber Accounts, Subscriber Data, and Subscriber Work Product will be accessed by DEALTEK's employees only to the extent necessary to provide and maintain customer support for DEALS. In addition, DEALTEK will maintain any information provided by the Subscriber for use in or with DEALS in such a manner that other Subscribers of DEALS will not have access to another Subscriber's information.
- Third Party Information Providers
DEALTEK partners with other third parties to provide specific information services. When the Subscriber registers for a Subscription License, except to perform a credit check if necessary, DEALTEK does not share names or other contact information with the third party information provider. These third parties are not allowed access to DELAS other than for the purpose of providing these information services.
- Business Transitions
In the event DEALTEK goes through a business transition, such as a merger, being acquired by another company, or selling a portion of its assets, Subscribers' personal information will, in most instances, be part of the assets transferred. Subscribers will be notified via email and by a prominent notice on the Site for 30 days prior to a change of ownership or control of their personal information.
- Links
The Site contains links to other sites. Please be aware that DEALTEK is not responsible for the privacy practices of such other sites. DEALTEK encourages our Subscribers to be aware when they leave our site and to read the privacy statements of each and every Web site that collects personally identifiable information. This privacy statement applies solely to information collected by DEALS.
- Tell-A-Colleague
If a Subscriber elects to inform a business colleague about DEALS or the Site, we ask the Subscriber for the colleague's name and email address. DEALTEK will automatically send the colleague a one-time email inviting him or her to visit the Site. DEALTEK stores this information for the sole purpose of sending this one-time email and tracking the success of our referral program. The colleague may contact DEALTEK at http://www.dealtek.com or http://deals.dealtek.com to request the removal of this information from our database.
- Security
This Web site takes every precaution to protect Subscriber Accounts, Subscriber Data and Subscriber Work Product. When Subscribers submit sensitive information via the Web site, their information is protected both online and off-line.
When our subscription order form asks Subscribers to enter sensitive information, that information is encrypted and is protected with the best encryption software in the industry - SSL. While on a secure page, such as our order form, the lock icon on the bottom of Web browsers such as Netscape Navigator and Microsoft Internet Explorer becomes locked, as opposed to un-locked, or open, when Subscribers are just "surfing."
While we use SSL encryption to protect sensitive information online, we also do everything in our power to protect Subscriber information off-line. All of our Subscribers' information, not just the sensitive information mentioned above, is restricted in our offices. Furthermore, ALL employees are kept up-to-date on our security and privacy practices. The servers that store personally identifiable information are maintained in a secure environment at a locked facility.
If Subscribers have any questions about the security at our Web site, Subscribers can send an email to rweiss@dealtek.com.
- Supplementation of Information
In order for this Site to properly fulfill its obligation to Subscribers, it is necessary for us to supplement the information we receive with information from 3rd party sources.
- Credit Check
To determine if Subscribers qualify for access to DEALS pre-payment, we use their name, company or entity tax payer identification number, or social security number to request a credit report. Once we determine a Subscriber's credit-worthiness, information is securely filed.
- Correcting/Updating/Deleting/Deactivating Personal Information
If a Subscriber's personally identifiable information changes (such as zip code, phone, email or postal address), or if a Subscriber no longer desires to subscribe to DEALS, DEALTEK provides a way to correct, update or delete/deactivate Subscribers' personally identifiable information. This can done by clicking on My Account or Contact Us within the DEALS system or by contacting DEALTEK by telephone at 1.650.305.1812.
- Notification of Changes
If we decide to change our privacy policy, we will post those changes to this Privacy Statement, the homepage, and other places we deem appropriate so our Subscribers are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We will use information in accordance with the privacy policy under which the information was collected.
If, however, we are going to use Subscribers' personally identifiable information in a manner different from that stated at the time of collection we will notify Subscribers via email. Subscribers will have a choice as to whether or not we use their information in this different manner. However, if Subscribers have opted out of all communication with the Site, or deleted/deactivated their account, then they will not be contacted, nor will their personal information be used in this new manner. In addition, if we make any material changes in our privacy practices that do not affect Subscriber information already stored in our database, we will post a prominent notice on our Web site notifying Subscribers of the change. In some cases where we post a notice we will also email Subscribers, who have opted to receive communications from us, notifying them of the changes in our privacy practices.
